DREDF Policy Recommendations for Reducing COVID-19 Nursing Home Deaths Through Innovative HCBS

On May 21, DREDF submitted data and policy information on several innovative home and community-based projects that could help reduce the steep rates of COVID-19 infection and death of disabled and older persons in nursing homes and other institutions throughout the U.S. Our submission recommends fostering partnerships among health plans, state and local entities, disability organizations, aging organizations, and health and home and community-based service providers to fill the service and support gaps experienced by people with disabilities of all ages who are sheltering in place in their communities. We equally emphasize the importance of data collection on where, when, and how people with disabilities and older persons are experiencing COVID-19 infections and deaths.

DREDF Submits Comments Opposing CMS' Proposed Narrowing of Nursing Home Screening Requirements

The comments point out that the PASRR rules should be updated to require broader review in light of legal and social trends toward community placement and away from segregated care, and highlight the inappropriateness of the proposed rule in light of the clear threat to life posed by nursing home residence during the current COVID-19 pandemic.

DREDF Calls for Effective Communication in COVID Treatment

June 1, 2023
DREDF, the Asian & Pacific Islander American Health Forum, the National Health Law Program, and 6 other organizations that advocate on behalf of Limited English Proficient populations and people with communication disabilities wrote a joint letter to Congress May 29. The letter urges federal lawmakers to provide funding, resources, and oversight to ensure that entities supporting the health of communities across the country during the COVID-19 pandemic provide the fully accessible and translated written and oral communication needed for equally effective healthcare.

DREDF Comments on USDOT Traveling by Air with Service and Emotional Support Animals Rule

April 7, 2023
DREDF submitted comments April 6 on the Department of Transportation’s (DOT) proposed rule to restrict travel by air with service animals and emotional support animals (ESA). DREDF opposes the rule’s limiting of service animals allowed on flights to dogs and weakening the rights of people who rely on ESAs. DREDF supports DOT’s proposal to treat psychiatric service animals as equal to all other service animals, and urges DOT to require reports on ESA incidents, and airline staff and contractors to be trained on how to interact with people who use service animals and service animal behavior.

DREDF Comments on HUD Affirmatively Furthering Fair Housing Proposed Rule

DREDF submitted comments on the Department of Housing and Urban Development’s (HUD) proposed rule to weaken the 2015 Affirmatively Furthering Fair Housing (AFFH) rule in an effort to reverse government progress on discriminatory housing practices. The proposal affects people with disabilities and communities of color by allowing local jurisdictions to leave unaddressed fundamental disability and racial segregation obligations of fair housing law. DREDF urges HUD to uphold its commitment to Affirmatively Furthering Fair Housing for people with disabilities and other covered classes, and to withdraw this proposed rule in its entirety and reinstate the 2015 AFFH Rule.

DREDF Comments on HHS Notice of Benefit and Payment Parameters for 2021

DREDF submitted comments to HHS on proposed rules that would affect the implementation of sections of the Affordable Care Act (“ACA”) that directly affect people with disabilities. In our comments, we urge HHS to withdraw proposals that would weaken the ACA’s “Essential Health Benefit” provisions, impose new financial reporting burdens on healthcare marketplace consumers, and make it more difficult for consumers to pay for prescription drugs. We also urged HHS to not expand the use of discriminatory “wellness programs” in health plans in the individual market. Finally, we supported HHS’ proposal to expand the availability of special enrollment periods for health care consumers.

DREDF Submitted Comments December 17 Against a Proposed HHS Grants Federal Rule

January 2, 2023
DREDF submitted comments December 17 advocating against a proposed federal rule that would allow the many entities that receive grants from the federal Health and Human Services agency (HHS) to discriminate on the basis of sexual orientation, gender identity, or religion in their programs and activities. HHS gives billions of dollars to organizations that deliver healthcare and social services in areas such as adoption, addiction recovery, and medical research. People with disabilities who are LGBTQ+ or who hold a particular religious faith are at risk of being denied participation in needed health services and supports from federally-funded private organizations that would be free to discriminate against certain clients and patients.

DREDF Submitted Comments to CMS Against Tennessee's Proposal to Block Grant its Medicaid Program

January 2, 2023
DREDF submitted comments to the Centers for Medicare and Medicaid Services against the state of Tennessee’s proposal to fundamentally alter how the state’s Medicaid program is funded, going from a program that must provide healthcare services, with matching federal support, to all eligible low-income persons in Tennessee to a program where the state can only rely on a set federal grant and is allowed to impose additional limitations on Medicaid-eligible Tennesseans. Tennessee has consistently proposed changes over the last few years to its Medicaid program that would be harmful to low-income persons with disabilities and chronic conditions.
